Condenado un hombre por abusar de su primo a quien confundió con su noviaRedacción GD
El ciudadano ecuatoriano M.R.Q.R., de 53 años, ha sido condenado por la Audiencia Provincial de Málaga a un total de cinco años de cárcel, por abusar sexualmente de su primo, F.C.Q., con quién compartió cena de Fin de Año y al que confundió con su novia tras emborracharse.
Según la sentencia, a la que tuvo acceso la prensa, los hechos ocurrieron cuando el acusado, que reside en Albolote, fue a pasar la Nochevieja de 2005 en Málaga, donde vivía su primo con su mujer e hijos.
Los primos cenaron juntos, se tomaron las uvas y tomaron cerveza hasta las cuatro de la madrugada, posteriormente descansaron varias horas, hasta que a las diez de la mañana comenzaron de nuevo a beber.
Sin embargo, dado el estado de embriaguez que presentaban, decidieron acostarse vestidos en la misma habitación, el procesado en la cama pequeña y en la grande su primo.
Aproximadamente una hora y media más tarde, el primo se despertó sobresaltado, con los pantalones y calzoncillos bajados y con un fuerte dolor en el ano.
Sobre él se encontraba el acusado, a quién propinó un codazo para apartarlo, e inmediatamente se dirigió a la cocina, cogió un cuchillo y salió dispuesto a vengarse de la supuesta afrenta sufrida.
Su esposa, que no entendía lo que sucedía, le sujetó con la ayuda de sus hijos y ordenó al procesado que se marchara inmediatamente de la casa.
La víctima salió corriendo tras él y logró retenerlo en casa, hasta que llegó la Policía, pero por vergüenza no contó lo sucedido.
Cuando el primo recibió asistencia médica, se comprobó que sufrió una fisura esfínter anal, que corroboró la penetración.
El acusado confesó ante la autoridad judicial que "se equivocó de cama a su regreso, cuando se levantó a orinar y había confundido a su primo con su novia".
Por estos hechos, la Sección Tercera ha condenado al hombre como autor de un delito de abusos sexuales con el atenuante de embriaguez, y deberá indemnizar a su primo con 6.000 euros por los daños morales.
